Acceptance of Terms
By accessing or using the Cellars at the Registry website, submitting a membership application, using a member account, or presenting a digital membership credential, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the relevant service.
Additional written membership rules, venue policies, application terms, or service-specific notices may also apply. If there is a conflict, the more specific terms will govern to the extent of that conflict.
Eligibility
You must be at least 25 years old, have the legal capacity to agree to these Terms, and meet the other lawful membership eligibility requirements established by Dreammind Group. There is no residency requirement for membership.
You may not apply or use an account on behalf of another person unless Dreammind Group has expressly authorized you to do so.
Website use
You may use the website for lawful, personal purposes connected with learning about Cellars, applying for membership, administering an authorized member account, and accessing available services. You must not interfere with the website, attempt to access restricted systems, or use content or services in a manner that violates these Terms or applicable law.
Membership applications
No guarantee of membership
Submitting an application does not guarantee acceptance, confer member status, reserve access to the premises, or create a contract for membership. Applications may be reviewed by authorized Dreammind Group personnel and approved service providers.
Application decisions
Dreammind Group may approve or decline an application in its discretion, exercised in accordance with its membership policies and applicable law. Nothing in these Terms authorizes a decision for an unlawful or discriminatory reason.
Accuracy of information
You must provide information that is accurate, current, complete, and your own. You must promptly correct material changes. Dreammind Group may pause or close an application if information appears materially inaccurate, misleading, fraudulent, or unverifiable, subject to applicable law and fair review.
Member accounts and security
If you receive a member account, you are responsible for activity conducted through it and for protecting your login credentials and devices. You must not share credentials, permit unauthorized access, or attempt to access another person’s account. Notify Dreammind Group promptly if you suspect loss, compromise, or misuse.
Dreammind Group may require reasonable verification before restoring access or changing account information. Account functionality and recovery methods are provided through approved systems and may change.
Digital membership credentials
A QR code, barcode, digital pass, Apple Wallet pass, membership number, or other credential issued for Cellars is personal to the authorized member and is not transferable. It may be used to verify membership status or identity for access to membership benefits, services, or the venue. It is not government-issued identification.
You must not duplicate, alter, sell, lend, publish, share, or fraudulently use a credential. Screenshots or copies may be rejected. Dreammind Group may deactivate, replace, or require additional verification for a credential that is expired, compromised, misused, or associated with an inactive membership.
Access to the premises
Membership does not guarantee entry at every time or for every event. Access may remain subject to operating hours, capacity, reservations, private events, dress or conduct standards, responsible service obligations, safety requirements, age verification, guest rules, and other lawful venue policies.
Digital credentials may support membership verification but do not replace any identification or documentation lawfully required for alcohol service or venue access.
Membership status, suspension, and termination
Membership status, duration, renewal, fees, privileges, and cancellation rights are governed by the membership agreement and policies provided to the member.
Dreammind Group may suspend or terminate membership or account access for material breach, non-payment where applicable, credential misuse, fraud, threats to safety or security, serious misconduct, or other grounds stated in approved membership policies, subject to applicable law and any contractual notice or review rights.
Member and guest conduct
Members and guests must act lawfully and respectfully, follow reasonable staff directions and venue policies, avoid harassment or discriminatory conduct, protect the privacy and safety of others, and refrain from conduct that damages property or disrupts the experience. The member may be responsible for ensuring that invited guests understand applicable venue rules.
Prohibited website activities
You must not:
- use the website or portal for an unlawful, fraudulent, abusive, or deceptive purpose;
- impersonate another person or misrepresent membership status;
- probe, scan, bypass, or defeat security or access controls;
- introduce malicious code or interfere with availability or performance;
- scrape, harvest, copy, or extract data or content through automated means without written authorization;
- reverse engineer or attempt to discover source code except where a restriction is prohibited by law;
- infringe intellectual-property, privacy, publicity, or other rights; or
- help another person engage in prohibited activity.
Intellectual property
The website and its text, design, branding, photography, graphics, and software are owned by or licensed to Dreammind Group or the relevant rights holder and are protected by applicable laws. You receive a limited, revocable, non-transferable right to access the website for its intended personal use. No ownership rights are transferred.
Third-party services and PeopleVine
Dreammind Group uses PeopleVine to support membership management and related functions. Information and account services may be provided directly through PeopleVine, and PeopleVine’s current terms and privacy practices may also apply.
Other third-party services and external links may be made available for convenience. Their operators control their content, availability, and terms. Dreammind Group is not responsible for an external service except to the extent responsibility cannot lawfully be excluded.
Availability and changes
The website, portal, and digital credentials may occasionally be unavailable because of maintenance, outages, security events, third-party failures, or circumstances beyond reasonable control. Dreammind Group may modify, suspend, or discontinue features and will provide notice where required by applicable law or an agreement.
Do not rely on the website or a digital credential as the sole means of obtaining urgent assistance or preserving essential information.
Disclaimers and limitation of liability
To the extent permitted by applicable law, the website and digital services are provided on an “as available” basis without warranties not expressly stated in an applicable written agreement. Dreammind Group does not warrant uninterrupted or error-free operation or that every defect will be corrected immediately.
To the extent permitted by applicable law, Dreammind Group will not be liable for indirect, incidental, special, consequential, or punitive loss arising solely from use of or inability to use the website, portal, or digital credential.
Nothing in these Terms excludes liability or rights that cannot legally be excluded or limited.
Indemnification
To the extent permitted by applicable law, you may be responsible for reasonable losses, claims, or costs arising from your unlawful conduct, fraudulent credential use, intentional misuse of the services, or material breach of these Terms. This provision does not apply to the extent a loss was caused by Dreammind Group or where indemnification would be unlawful or unfair.
Privacy
Dreammind Group’s handling of personal information is described in the Privacy Policy. That Policy distinguishes Dreammind Group’s responsibilities from services provided by PeopleVine and other providers.
Changes to the website or Terms
Dreammind Group may update these Terms to reflect changes in services, membership operations, or applicable requirements. The current version will display its effective date. Material changes will be communicated where required. Continued use after an update takes effect constitutes acceptance only to the extent permitted by applicable law.
Governing law and general terms
Governing law
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law rules.
Severability
If a provision is held unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.
No waiver
A failure to enforce a provision is not a waiver of the right to enforce it later.
Assignment
You may not transfer your account, credential, or rights under these Terms. Dreammind Group may assign these Terms as part of a lawful reorganization or transfer of the relevant business, subject to applicable law.
Entire agreement
These Terms, the Privacy Policy, and any applicable membership agreement or expressly incorporated policy form the agreement governing the relevant service.
